LIMITED WARRANTY STATEMENT

WHAT IS COVERED?

Statutory Warranty

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

 

Where you are not a “consumer” within the meaning of the Australian Consumer Law, the Statutory Warranty does not apply. Nothing in this warranty is intended to exclude, restrict, or modify any consumer rights under the Australian Consumer Law. This warranty is in addition to, and does not limit, exclude, or modify any rights or remedies you may have under the Australian Consumer Law or other applicable laws.

Our Warranty

Under normal conditions and ordinary use, Layback Lawn Pty Ltd (“Layback Lawn”) warrants its synthetic grass (except clearance products) for 10 years against:

  • Ultraviolet degradation of more than 50% during the Warranty Period due to a defect or fault with the product.

The Warranty Period commences from the date of delivery. This warranty shall only cover Layback Lawn products used for normal domestic landscaping applications or any other application recommended by Layback Lawn.

Layback Lawn will replace or repair, at its sole discretion, the defective products or parts thereof. Replaced products become the property of Layback Lawn.

The warranty does not apply if the products are used for applications other than those recommended by Layback Lawn. (Refer to details on the Layback Lawn website).

WHAT IS NOT COVERED?

Layback Lawn does not cover the following:

1. Non–Layback Lawn products;

2. Change of mind or customer error in choosing or cutting the product;

3. Normal wear and tear;

4. Any shrinkage of the product;

5. Defects or damage resulting from cutting, negligence, misuse or abuse;

6. Defects or damage from vandalism;

7. Defects or damage caused by machinery (including but not limited to cars and other vehicles);

8. Defects or damage caused by animals;

9. Defects or damage from fire or chemical reaction;

10. Defects or damage resulting from natural disasters;

11. Use of inappropriate sports equipment or footwear;

12. Cuts or burns;

13. Damage due to excessive heat, including magnified sun energy from glass, Colourbond fencing or reflective surfaces;

14. Damage resulting from failure to maintain, protect or repair the product as recommended by Layback Lawn;

15. Faulty subsurface preparation or failures in the subsurface (e.g., shallow reticulation pipes, collapsed soak wells, voids etc.);

16. Sub-base issues such as settling or drainage failures from works by others prior to installation;

17. Improper handling, installation or repairs (including unapproved infill materials such as white washed sand);

18. Damage from repair or attempted repair by anyone other than a Layback Lawn installer;

19. Damage caused by delay in reporting a defect not notified to Layback Lawn within 14 business days, or use of product against Layback Lawn recommendations;

20. Where payment for products and/or services has not been received in full.

WARRANTY PERIOD

  •  Product Only Purchases: 10 years from original purchase date.
  • Product + Installation Purchases: 10 years for the product and 3 months for installation services for residential clients, or 1 year warranty for commercial projects.

WHO IS COVERED?

This limited warranty covers only the original purchaser of the product. It is non-transferable (does not apply after property title transfers).

 

HOW TO OBTAIN WARRANTY SERVICES

Upon delivery, it is the customer’s responsibility to ensure goods conform to their specifications and requirements. Claims for defects or damage visible on delivery will only be accepted if submitted in writing within 90 days of delivery.

  • Defects from installation by Layback Lawn must be reported within 30 days of becoming aware of the fault.
  • For UV degradation defects, claims must be lodged within 8 years of receipt of product.

All warranty claims must include:

  • Your name, address, and contact information;
  • Proof of purchase from Layback Lawn;
  • At least 3 clear photos of the affected areas;
  • A description of the problem.

Do not attempt to repair or alter the product yourself, as this will void the warranty.

The customer must pay the full price charged by Layback Lawn for goods or services supplied, without any deductions or setoffs, upon delivery or performance. The customer is not entitled to withhold any payment to Layback Lawn, even in cases of alleged defect under this warranty. This includes, but is not limited to, claims of faulty or defective goods, inadequate service standards, or delays in providing goods or services. However, this clause does not affect the customer’s rights regarding any alleged failure of a guarantee under the Australian Consumer Law.

If any invoice for goods or services supplied remains unpaid, Layback Lawn reserves the right to withhold warranty work until all outstanding amounts are paid in full.

 

If you fail to notify us of your warranty claim in accordance with the requirements outlined in this warranty, Layback Lawn is not obligated to investigate the claim or carry out any repairs or replacements.

WHAT WILL LAYBACK LAWN DO?

Layback Lawn endeavors to handle all warranty claims promptly and professionally. At its sole discretion, Layback Lawn will repair or replace any product or area found to be defective or covered under this warranty. 

Upon receiving a claim, Layback Lawn will:

1. Contact you via email to discuss the claim;

2. Inspect the affected product or area if the issue cannot be resolved via email;

3. Notify you within 7 days whether the claim is eligible for acceptance.

If the claim is accepted:

For Product Only Purchases:

  • Reasonable steps will be taken to rectify the defect, taking into account product age and normal wear.
  • Repairs or replacements may use new, refurbished, or reconditioned materials. Dye lot matching is not guaranteed.

For Product + Installation Purchases:

  • Layback Lawn requires access to the product to carry out works, and the customer’s presence during the works.
  • Affected areas may be replaced with similar or new product (dye lot matching not guaranteed).

Any warranty works will carry the remaining period of the original product/workmanship warranty.

Layback Lawn will not be responsible for any costs or expenses you incur in notifying us of a warranty claim.

If a claim is not accepted, the customer will be liable for costs of inspection at Layback Lawn’s usual hourly rate of $139/hr + GST.

LIMITATION OF LIABILITY

Layback Lawn will not be liable to pay or reimburse for indirect, incidental, or consequential losses (including loss of profit, income, goodwill, or business) except where required under the Australian Consumer Law.

 

The only conditions, guarantees, and warranties binding on Layback Lawn regarding the state, quality, or condition of the goods and/or services (including advisory services) are those imposed and required by statute, including the Australian Consumer Law, which cannot be excluded.

The customer must bear the costs of returning any products for which a warranty claim is made, unless the cost of returning, removing, or transporting is significant.

 

All other conditions, guarantees, and warranties—whether express or implied by law—regarding the state, quality, or condition of the goods and/or services are hereby expressly excluded to the fullest extent permitted by law.

 

Subject to the statutory warranty and the express warranty provided herein, Layback Lawn has no liability to any person for any loss or damage whatsoever. This includes, without limitation, any indirect or consequential loss (such as loss of profits, income, wages, business, revenue, opportunity, goodwill, or losses arising from any failure, breakdown, defect, or deficiency in the goods and/or services) arising out of or in connection with the goods and/or the provision of the services.

DISCLAIMER

As with any manufactured product, occasional colour variations may occur between dye lots. No two batches will be exactly the same. Layback Lawn cannot be held responsible for any differences in colour shading. No person or party may create any obligation or liability for Layback Lawn beyond the guarantees expressly stated in this warranty.

 

The customer expressly agrees that the use of the products and services is at their own risk. To the full extent permitted by law, Layback Lawn

 

All information, specifications, and samples provided by Layback Lawn in relation to goods or services are approximations only. Subject to any guarantees under the Australian Consumer Law, minor deviations or slight variations that do not substantially affect the customer’s use of the goods or services will not entitle the customer to reject the goods upon delivery or make any claim in respect of them.

 

Any advice, recommendations, information, assistance, or services provided by Layback Lawn in relation to goods or services are given in good faith and are believed to be accurate, appropriate, and reliable at the time. However, they are provided without any warranty regarding accuracy, appropriateness, or reliability. Layback Lawn does not accept any liability for any loss suffered as a result of the customer’s reliance on such advice, recommendations, information, assistance, or services.
